Change of Status/Extension

(1) Change of Status

    1. You may not change your status if you were admitted into the U.S. in the following categories:
      1. Visa Waiver Program
      2. Crew Member (D nonimmigrant visa)
      3. In transit through the U.S. (C nonimmigrant visa)
      4. In transit through the U.S. without visa (TWOV)
      5. Fiancé of a U.S. citizen or dependent of a fiancé (K nonimmigrant visa)
      6. Informant (and accompanying family) on terrorism or organized crime (S nonimmigrant visa)
    2. If you are a vocational student (M-1), you may not change your status to
      1. F-1
      2. Any H status, if the training you received as a vocational student in the U.S. provided the qualification for the temporary worker position you seek.
    3. If you are an international exchange visitor (J-1), you may not change your status if 
      1.  You were admitted to the U.S. to receive graduate medical training, unless your receive a special waiver
      2. You are an exchange visitor and are required to meet the foreign residence requirement, unless you receive a special waiver

(2) Extension of your stay

    1. You may apply to extend your stay if:
      1. You were lawfully admitted into the U.S. with a nonimmigrant visa
      2. Your visa status remains valid
      3. You have not committed any crimes that make you ineligible for a visa
      4. You have not violated the conditions of your admission
      5. Your passport is valid and will remain valid for the duration of your stay
    2. You may not extend your stay if you were admitted into the U.S. in the following categories:
      1. Visa Waiver Program
      2. Crew member
      3. In transit through the U.S. (C nonimmigrant visa)
      4. In transit through the U.S. without visa (TWOV)
      5. Fiancé of a U.S. citizen or dependent of a fiancé (K nonimmigrant visa)
      6. Informant (and accompanying family) on terrorism or organized crime (S nonimmigrant visa)
